RENTAL OF A HOLIDAY HOME FOR TOURIST USE
Landlord: Reinhard Kurt Hafermalz born in Berlin on 23.1.1961 and resident in Olbia,Via Sannai 41, Italian tax code: HFRRHR61A23Z112I
and the tenant of the holiday home VILLA ELLA. (hereinafter also referred to as the parties).
1) Object of the contract
The Lessor hereby rents to the Lessee, who accepts this in the same factual and legal situation, exclusively for tourist use and to the exclusion of any other use, the accommodation unit located in Olbia ( SS ), via di Sannai 41, consisting of 3 rooms, including 2 bedrooms with 2 bathrooms, which is wholly owned by the Lessor. The number of guests for the duration of the stay is 4 persons . The maximum occupancy is 4 people and one infant.
2) Obligations and prohibitions
The tenant undertakes to use the property for civil residential purposes for tourism purposes only.
The tenant is prohibited from subletting the property or allowing third parties to use it, even if this is only temporary and/or unsafe, as this will result in the termination of this contract.
The tenant is obliged to maintain and care for the property with due care, to ensure that it is properly maintained, not to alter or modify it and to return it at the end of this contract in the condition in which it was received, with the exception of normal deterioration due to use.
The tenant undertakes to notify the landlord of any defects in the apartment and furniture within 1 day of handing over the keys and no later than 2 hours after arrival.
The tenant undertakes to comply with the municipal regulations on waste separation, to separate the waste as specified in the regulations and to comply with the collection times. He also undertakes to indemnify the landlord for any fines levied as a result of waste collection errors attributable to the tenant during his stay. In the event of gross neglect of sorting, a fee of €100 will be charged for subsequent sorting.
3) Duration
This contract is limited in time and is valid for the duration of the booked rental period.
Upon expiry, it ends without the need for cancellation, which is to be understood as given now, with the obligation of the tenant to return the property to the landlord.
4) Rent and ancillary costs
A rent is agreed as per the booking confirmation, which the tenant undertakes to pay upon conclusion of the following contract.
5) Transfer
The contract is deemed to have been concluded upon payment of the holiday home rent.
6) Arbitration clause
With the conclusion of the booking, the parties agree to accept the regulations and the arbitration clause that regulates the possible settlement of any disputes that arise or have arisen by submitting everything to the compulsory civil arbitration and/or arbitration chamber of the Arbitration Centre – Arbitration Chamber – of ‘Italia Concilia’, which is attached to this contract.

House rules holiday home VILLA ELLA
Dear guests,
We welcome you to the Villa ELLA holiday home.
We have taken care of every detail so that you can feel at home during your stay. To ensure a harmonious stay, we kindly ask you to read and respect the following rules:
Art.1 Acceptance of the rules
- By staying at ‘Casa Vacanze ELLA’ you implicitly accept these regulations.
Art. 2 Check-in
- Check-in is possible from 3.00 pm on the day of arrival by prior arrangement with the host or the person in charge.
- The tenant and any guests must present a valid identity document, as their presence must be reported to the municipality.
- The keys and a smartphone to control the lighting of the accommodation unit will be handed over; in the event of loss or damage, notify the landlord as soon as possible. Any costs incurred will be borne by the tenant.
- Any damage and/or deterioration of any kind found by the tenant to the structure and the equipment inside the structure and to the vegetation must be reported immediately to the landlord and/or the person in charge no later than 2 hours after check-in, after which time they may be charged to the tenant.
Art. 3 Check-out
- Check-out is by 10.00 a.m., unless otherwise agreed.
- The return of the keys and the smartphone provided on departure is mandatory.
- Upon departure, the Lessor and/or the person in charge has the right to inspect and report any damage and/or deterioration of any kind caused by the Lessee or the guests to the facility, to the equipment and appliances of the entire facility and to the vegetation, reserving in any case the right to report to the Lessee (as the person solely responsible) within 24 hours of departure any damage, indicating the estimated amount of damage in euros for possible reimbursement.
Art. 4 Rules of behaviour
Misbehaviour, activities, games and the use of equipment that disturb other guests must be avoided at all times in the facility. Adults are responsible for the behaviour of the minors entrusted to their care, and the operator of the establishment is not liable for accidents of any kind caused by the lack of supervision and care of minors by their parents or guardians. Behaviour must at all times be such that the peace and quiet of others is not disturbed at any time of the day.
- The tenant and each guest is responsible for the storage of their personal belongings and valuables in the flat; the owner is not liable for their unfortunate theft or loss. A safe is available to secure valuables.
- The tenant and each guest is responsible for their own behaviour in the house and its surroundings and will be held liable for damages in the event of accidents for which they are responsible.
- Before leaving the accommodation unit, the tenant and/or guests are obliged to lock the front door and windows, switch off the lights and all electrical appliances (TV, cooker, air conditioning, etc. …..) and turn off the taps. The system can be controlled and monitored via SmartHome. If electrical appliances are forgotten to be switched off when leaving the property, the landlord has the right to switch them off without entering the premises.
- It is strictly forbidden to use cookers or similar appliances to prepare food in the bedrooms;
- Only the number of people specified at the time of booking may stay in the accommodation; no exceptions are permitted
The areas authorised for guests are as follows:
- Use of the swimming pool from 09.00 to 19.00 – use is strictly prohibited outside the specified times unless express authorisation has been obtained.
- The main house is off-limits to guests for the duration of their stay, unless expressly authorised by the owner.
- The wooden terrace below the pool is designed for all guests and is available for leisure activities and relaxation.
Art. 5 Cleaning and service
- You will find everything you need in the flat: Blankets, sheets, pillows, towels, crockery and household appliances.
- Bed linen (which you will find clean at the beginning of your stay) is changed once a week (or every time there is a change of guests) and towels are changed three times a week.
- The guest is responsible for the cleanliness and tidiness of the rooms and the pool, fitness and leisure areas during their stay.
- The cleaning of the kitchenette and crockery is the sole responsibility of the guest;
- It is forbidden to block the toilet with nappies, paper or other bulky material. Separate waste bins are provided in the bathrooms for hygiene products.
- Use the waste bins provided for the separate collection of plastic, metal, paper and moist residual waste. Filled bags can be deposited in the designated waste collection points. In the event of non-compliance, the guest may be required to pay a fine if the waste collection service detects any anomalies;
- The consumption of electricity and water as well as the final cleaning of the property are included in the rental price. Please switch off all electrical appliances (with the exception of the refrigerator) when leaving the flat.
- Unforeseen additional costs for special requests are the sole responsibility of the guest
- Please do not use the bathroom towels as beach towels. A set for the beach will be provided on request.
Art. 6 Prohibitions
- Noise is prohibited from 1.00 pm to 3.30 pm and from 11.00 pm to 7.00 am.
- Parties, celebrations or similar events are not permitted unless expressly authorised by the landlord.
- Smoking is prohibited in the house and in the immediate vicinity of the pool area.
- It is forbidden to remove or damage furniture and furnishings.
- Bottles and glasses are prohibited in the immediate pool area.
Art. 7 Deposit
- The deposit for the stay amounts to 20% of the value of the rental price for the entire stay and is paid by the tenant upon signing the contract together with the agreed rental amount. The deposit will be refunded in full at the end of the stay, with the exception of any damage for which a deduction will be made;
- In the event of damage, subject to agreement on the amount of the damage, this amount will be deducted from the deposit paid; in the event of damage exceeding the amount of the deposit itself, the tenant must pay a further amount to settle the damage;
- If no agreement is reached on the amount of the damage, the deposit will be retained in full and will not be refunded at the end of the stay; invoices and/or receipts for any refund or compensation will follow in the following days.

Art. 9 Place of jurisdiction
The parties (landlord and tenant) mutually acknowledge that in the event of any disputes, they shall refer to the civil conciliation and/or arbitration chamber of the conciliation organisation ‘Italia Concilia’, based in Piano (BO) – Olbia branch, via F.lli Cairoli nr 7/B. By signing these regulations, the parties accept what is written here and sign the mediation/arbitration clause attached to the contract and these regulations. The Court of Tempio Pausania shall have territorial jurisdiction.
